Unless otherwise stipulated in writing, the placing of an order at HōRNō shall constitute the acceptance by the User of these legal conditions. No stipulation made by the User may differ from those of HōRNō if it has not been expressly accepted in advance and in writing by HōRNō.
-Once the payment is made( see payment terms) and once it has been verified that it has been received, HōRNō will proceed with the processing and delivery of the purchase within a period of 7-10 days from the receipt of the payment and according to the population of destination and the method of payment chosen.
-All purchases are delivered by express courier, according to the destination freely designated by the User.
-The delivery dates or deadlines shall be deemed approximate, not constituting the essential default delay. In the event that HōRNō has not delivered the goods within 30 days of the agreed delivery date, the customer will be entitled to cancel the order and receive a refund of the total amount paid at no cost, and without incurring any liability for damages attributable to HōRNō.
-The shipping price will be specified at the time of purchase.
-You will receive informative emails about the entire process of your purchase: receipt, order in process and shipping.
-The sending of photographs will be wound in a cardboard tube properly protected, guaranteeing the reception of the purchase in perfect condition.
-If they are pictures or other non roll-up product, they are sent without frame and protected for reception in perfect condition.
-All purchases made in Horno.eu will be delivered with its Certificate of Authenticity, guaranteeing to the customer the authenticity of the same and indicating if it is a single or limited copy, with the characteristics of the same.
-HōRNō will not assume any responsibility when the delivery of the product or service does not take place, because the data provided by the User is false, inaccurate or incomplete.
-The delivery shall be deemed to have been made at the time when the carrier has made the product(s) available to the User and the User, or his delegate, has signed the document of receipt of the delivery.
-It is up to the User to verify the products upon receipt and to state all the qualifications and claims that may be justified in the document of receipt of the delivery.
3. RETURNS. RIGHT OF WITHDRAWAL
Our main interest is to achieve the maximum satisfaction in our customers, so if you are not satisfied once received your purchase has 14 calendar days, counted from the day of reception (article 71 of the Law 3/2014, of 27 March) to make the return.
The product to be returned is sent and paid by the User.
The conditions for accepting returns are as follows:

-The product has to reach us in perfect condition and with the same original packaging in perfect condition too. 5. FORCE MAJEURE
The parties shall not be liable for any fault due to a greater cause. Compliance with the obligation shall be delayed until the termination of the case of force majeure.
The User may not assign, transfer or transfer the rights, responsibilities and obligations contracted in the sale.
If any stipulation of these conditions is deemed null or void, the validity, legality and compliance of the rest shall not be affected in any way, nor shall it be modified in any way.

Given the continuous technical advances and product improvements, HōRNō reserves the right to modify its specifications in respect of the information provided in its advertising, until it affects the value of the products offered. These amendments shall also apply if, for any reason, the possibility of supplying the products offered is affected.
8. PRICE AND PERIOD OF VALIDITY OF THE OFFER
Prices indicated for each product include value added tax (VAT) or other taxes that may be applicable. These prices, unless expressly stated otherwise, do not include shipping, handling, wrapping, shipping insurance or any other additional services and attachments to the purchased product or service.
The prices applicable to each product are those published on the website and will be expressed in the EURO currency. The User assumes that the economic valuation of some of the products may vary in real time.
Before making the purchase, you can check all the details of the selected products online: items, quantities, price, availability, transport costs, charges, discounts, taxes and the total purchase. Prices can change daily while the order is not made.
Once the order is placed, the prices will be maintained whether there is product availability or not, unless it is a limited product and due to a system error it may appear that there are products available when they are already out of stock.
Any payment made to HōRNō involves the issuance of an invoice in the name of the User or of the company name that he has informed at the time of placing the order. This invoice will be sent together with the purchased product to the email address provided by the User.

11. GUARANTEES AND RETURN
The guarantee of the products offered will respond to the following articles based on the Law 23/2003, of 10 July, on Guarantees of sale of consumer goods:
I) Conformity of products with the purchase:
1. Unless there is evidence to the contrary, products will be deemed to meet what has been purchased, provided they meet all of the requirements set forth below, unless the circumstances of any of these circumstances make them unenforceable:
a) According to Hōrnō’s description.
(b) Are suitable for the uses for which the products of the same type are normally intended.
c) Present the usual quality of a product of the same type that the customer can reasonably expect, taking into account the nature of this and, where appropriate, the descriptions of the specific characteristics of the products made by HōRNō.
d) HōRNō describes the details and technical characteristics of the materials used in its products provided by the manufacturer thereof, so that it is not bound by these public statements.
II) HōRNō’s responsibility:
HōRNō will be liable to the User for any non-conformity that exists at the time of delivery of the product. HōRNō recognizes the User’s right to repair the product if possible, to replace it, to reduce the price and to cancel the purchase.
III) Repair and replacement of products:
1. If the product is not in conformity with the contract, the User may choose to require repair or replacement, unless one of these options is impossible or disproportionate. From the moment the User informs HōRNō of the chosen option, both parties must comply. This decision of the User is without prejudice to the provisions of the following article IV in cases where the repair or replacement fails to bring the product into conformity with the contract.
2. Any form of sanitation that imposes costs on HōRNō that, in comparison with the other form of sanitation, are not reasonable, taking into account the value that the product would have if there was no lack of conformity, the relevance of the lack will be considered disproportionate. in accordance and if the alternative form of sanitation could be carried out without major inconveniences for the User.
IV) Rules for the repair or replacement of the product:
Repair and replacement will conform to the following rules:
a) They will be free for the User.
This gratuity will include the necessary costs incurred to remedy the non-conformity of the products with the contract, in particular shipping costs, as well as labour and material costs.
b) They will be carried out within a reasonable time and without major inconvenience to the User, taking into account the nature of the products and their purpose for the User.
(c) Reparation suspends the computation of the periods referred to in article III. The period of suspension will begin when the User makes the product available to HōRNō and end with the delivery of the repaired product to the User.
d) The substitution suspends the terms referred to in Article III from the exercise of the option until the delivery of the new product.
e) If the repair is completed and the product is delivered, it is still not in accordance with what has been agreed, the User may demand its replacement, within the limits established in section 2 of article III, or the price reduction or return of the purchase in the terms of article V.
f) With the substitution it would be possible to bring the product into conformity with what was agreed in the purchase.
g) The User may not demand the substitution in the case of non-expendable products.
V) Price reduction and return of purchase:
The reduction of the price and the return of the purchase will proceed, at the choice of the User, when the latter cannot demand the repair or replacement of the product and in the cases in which these have not been carried out within a reasonable time or without major inconveniences for the user. The return will not proceed when the lack of conformity is of little importance.
VI) Criteria for price reduction:
The price reduction will be proportional to the difference between the value that the product would have had at the time of delivery had it been in accordance with the contract, and the value that the product actually delivered had at the time of delivery.
VII) Time limits:
1. Unless there is proof to the contrary, delivery will be deemed to have taken place on the day indicated on the invoice or purchase label or on the delivery order in question, whichever is the later.
2. The User will inform HōRNō of the non-conformity within 14 days of receiving the product.
Unless proven otherwise, it will be understood that the User’s communication has taken place within the established period.
12. APPLICABLE LAW AND JURISDICTION
These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established. HōRNō and the User agree to submit to the Courts and Tribunals of Madrid (Spain) any controversy that may arise from the provision of the products or services object of these Conditions.
In the event that the User is domiciled outside Madrid (Spain), HōRNō and the User expressly waive any other forum, submitting to the Courts and Tribunals of Madrid (Spain).
TERMS AND CONDITIONS OF USE
